Minutes of the LVT meeting of September 21, 2007:
The meeting was called to order by President Joe Marcianti. Other Officers and Directors present
were Lach Cameron, Alice Bass, Celeste Brockwell and Ann Gorga. Absent was Pamela Boright.
The Minutes and Treasurer's report were accepted as read.
Guest speaker Kathleen McKenzie Cupano, Program Development Administrator from the Center
for Government Services from Rutgers University spoke to the Association about the different
types of Government under the Faulkner Act:
- Initiative and referendum is part of all Faulkner Act forms of government
- Initiative empowers the voters to propose and enact legislation themselves. An ordinance is proposed by petition and either adopted or rejected at the polls.
- Referendum empowers the voters to approve or reject at the polls any ordinance submitted to them by the municipal council or any ordinance passed by the council, against which a referendum petition has been filed.
- After 3 years, if you are not satisfied with the form of Faulkner you have chosen, you may choose another Faulkner option or revert back to what you were.
Questions and answers followed and Ms. Cupano was thanked for her presentation.

Membership: 719 memberships to date
Correspondence: Three letters were received related to:
- Yellow curb painting
- Lack of driveways and parking for some residents
- Summer noise due to construction with Mantoloking's ordinance related to same
- Cleaning of the storm drains
Storm drain clean-outs: Storm water management regulations require a schedule for clean
out of storm drains on county and local roadways. If there is a special situation prior to
the scheduled clean out, the County can be contacted on a
per-need basis. State highways do not have to comply with scheduled storm drain cleanouts.
Beach report: Alice Bass asked the Administrator for a Beach report addressing the summer
season. She was only provided with a partial report of income, but not expenses. She will request
the additional information. Feels Beach should be opened on Memorial Day to increase Beach revenue
to be reinvested in the beach and boardwalk rather than bonding for repairs and maintenance. Also,
if possible, under the "umbrella of the Beach" Councilman Ardito feels we should provide crossing
guards in the summer for safety of everyone.
Municipal report:
- Minutes of Council minutes will be posted online
- Discussion of background checks by Lavallette Police Department for all volunteer organizations
- Bond ordinance to repave White and Ortley Aves. and Coleman Lane.
- Bond $100,000 for Public Works vehicles
- Ordinance to limit ground coverage 18" and under to 20% of property; structures are limited to 37%--unchanged.
- Discussion by Council to number curbs with street address'
- Rules developed for clean-up of Gazebo area after use by the public
- Problem of Lori bus traveling on Bay Blvd. rather than designated Rt. 35
- Council supported Assembly Bill A2775 allowing towns to paint curbs at a distance less than 50' from a stop sign to provide parking relief in towns
- Bay Beach Way property owners in Toms River Twp. Want to secede from Toms River and join Lavallette. Council passed a resolution that if the owners are successful in seceding, they would be welcome to join Lavallette
- Resolution tabled to award a contract to repair Tennis Courts
- Faith Lutheran Church would like a traffic light at the corner of Rt. 35 North and New York Ave.
- Mayor to appoint an advisory committee to study the parking situation. Councilman Ardito feels all organizations should be invited to submit a representative to participate on the parking commission.
- Legal bills to the taxpayers are mounting related to the issue of use of a liquor license by a local restaurant
- The Department of Transportation is marking utilities on Rt. 35 in preparation for a repaving project probably in 2009-retention basins, upgrading to storm drains, upgrading pipe sizes to handle more water and installation of flaps that open and close to the Bay.
Dues for LVT for 2008 will remain the same at $10 for household membership which includes up to two persons.

Candidate's night co-sponsored by LVT and The West Point Island Civic Association is slated for October 19th at 7:30 p.m.
The four candidates vying for the two seats on Lavallette Council will be sent invitation letters.

Pay-to-Play: The Citizen's Campaign Reform is pushing ahead for Pay-to-Play reform in more municipalities.
